1. Acceptance of terms

By downloading, installing, or using ASAKI ("the app"), you agree to these Terms of Service. If you do not agree, please do not use the app. These terms work alongside the Privacy Policy, which is incorporated by reference.

2. What ASAKI is

ASAKI is a voice-deactivated morning alarm that assembles a personalized briefing from your Google Calendar, Gmail metadata, and tasks you enter — processed on your device, as described in the Privacy Policy. It is a convenience tool, not a system of record or a substitute for your own calendar, email client, or alarm of last resort.

3. Your Google account

You are responsible for your own Google account, its credentials, and the permissions you grant. You represent that you have the right to connect any account you link to ASAKI. You can revoke ASAKI's access at any time via your Google Account permissions.

4. As-is, no warranty

ASAKI is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. You use the app at your own risk.

5. Briefing accuracy

Briefings are generated automatically and may be incomplete, delayed, or wrong — including summaries of email and calendar events. Do not rely on ASAKI for time-critical, medical, financial, legal, or safety-critical decisions. Always confirm important details in your primary calendar and email. ASAKI is not responsible for missed events, misread messages, or an alarm that does not sound due to device settings, battery optimization, permissions, or operating-system behavior.

6. Availability & no service-level guarantee

ASAKI's optional summarization service is self-hosted and offered on a best-effort basis. There is no uptime guarantee and no SLA; it may be slow, unavailable, or discontinued at any time. When it is unavailable, the app falls back to a rule-based, on-device digest. Core alarm and on-device briefing features are designed to work without it.

7. Acceptable use

You agree not to misuse the app: no reverse engineering except as permitted by law, no attempts to disrupt or overload the summarization service, no use of the app to violate any law or another person's rights, and no use of automated means to abuse the service.

8. Intellectual property

The ASAKI name, the Viscacha mascot, the app, and its original content are owned by ASAKI and its creator and are protected by applicable laws. These terms grant you a personal, non-exclusive, non-transferable, revocable license to use the app for its intended purpose. Your data remains yours.

9. Limitation of liability

To the maximum extent permitted by law, ASAKI and its creator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the app — including any reliance on a briefing or any failure of an alarm to sound.

10. Termination

You may stop using ASAKI at any time by uninstalling it, which removes its on-device data. We may suspend or discontinue the app or the summarization service at any time. Sections that by their nature should survive termination (such as warranty disclaimers and liability limits) will survive.

11. Governing law

These terms are governed by the laws of your place of residence, without regard to its conflict-of-law rules, except where applicable local law requires otherwise. Nothing in these terms removes consumer-protection rights you have under the mandatory law of your jurisdiction.

12. Changes to these terms

We may update these terms from time to time. When we do, we will revise the effective date above and post the updated terms at this URL. Continued use of the app after changes take effect means you accept the revised terms.

13. Advertising

ASAKI is free and supported by ads served through Google AdMob. By using the app, you agree that ASAKI may display ads — including non-personalized ads — within the app. Ads, and any third-party content or links they contain, are provided by Google and advertisers, not by ASAKI; we do not endorse and are not responsible for that content or any site it leads to. Advertising is also subject to Google's advertising policies. How advertising data is handled is described in our Privacy Policy — your Gmail and Calendar data are never used for ads.
